Alerts API Terms

1. Who this is between

This agreement is between the business you represent (the "Customer") and bujusjujus LLC, an Arizona limited liability company ("bujusjujus," "we," "us"). The "API" means our programmatic access to product-availability information, including the MCP endpoint, long-poll tools and webhooks. "API Data" means everything the API returns.

You accept these terms by paying for, claiming or using an API key.

2. Business use only; eligibility

By accepting, you confirm that:

• you are accepting on behalf of a business or other organization, or as a sole proprietor acting in the course of your trade, and not as a consumer;
• you are at least 18 and have authority to bind the Customer;
• the Customer is located in the United States; and
• the information you give us, including the email address on the account, is accurate and kept up to date.

Keys are issued automatically and no approval is implied by our issuing one. We do not review, endorse or approve any Customer or any intended use, and issuing a key is not a statement that your use complies with these terms, with any retailer's terms, or with the law — that remains your responsibility under Section 3. We may refuse to issue a key, and may suspend or end any subscription or revoke any key, at any time and for any lawful reason.

3. What you are buying: information

API Data is information about product availability and pricing at third-party retailers. We do not sell products, operate stores, place orders, operate purchasing software, or act on your behalf with any retailer. We are not a party to any transaction between you (or your users) and a retailer. Retailer links in API Data are provided for convenience and do not carry our affiliate or referral tracking.

What you do with API Data is your decision and your sole responsibility. You must not use API Data, or allow it to be used, in any way that violates a retailer's terms of sale or of use, its purchase limits or any law. Nothing in these terms authorizes, endorses or encourages any such use, and nothing in them limits the Terms of Service Section 9 prohibitions on automated purchasing, botting and scalping.

4. Your licence

While you hold a valid, unrevoked key and comply with these terms, we grant the Customer a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access the API and to use API Data in the Customer's own products and services, including commercially. In particular, you may display API Data to your own end users. That permission replaces, for API Data only, the Terms of Service Section 9 prohibitions on redistribution and on non-personal or commercial use, and extends the licence in Terms Section 10.

We keep all rights not expressly granted. The API, our software and our aggregated data remain ours.

5. Your end users and your products

You are solely responsible for your products and services, for your end users, and for how either uses API Data. That includes your own terms with your users, any disclaimers they need, and your compliance with consumer-protection, advertising and privacy law.

If you show API Data to others, you must not present information as confirmed when the API marks it low confidence (unverified), and you must not present API Data as a guarantee that any product is available. Your end users are not parties to these terms and have no rights under them.

6. Our name

You may credit API Data to bujusjujus (for example, "Data from bujusjujus"), but you are not required to. We may ask you to remove any credit, at any time and for any reason, and you must do so promptly. You must not use our name, logo or trademarks in advertising or marketing, or in any way that suggests a partnership, endorsement or sponsorship by us. The same applies to any retailer, The Pokémon Company and Nintendo.

7. Acceptable use

You must not:

• share, sell or publish your API key, or let anyone outside your organization use it;
• resell or relay raw access to the API itself, for example a proxy that passes our endpoint through to others;
• exceed or try to evade your quota or rate limits, including by using several keys or accounts;
• try to find out how we obtain availability information, including by probing, correlating or reverse-engineering the API;
• probe, scan or test the security of the API, or interfere with its operation;
• use the API to harass, defraud or mislead anyone, or in violation of any law.

8. No warranty; accuracy and availability

THE API AND API DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS AND NON-INFRINGEMENT.

Availability changes constantly, and products can sell out within seconds. API Data can be late, missing, duplicated or wrong, and low-confidence information is an unverified report. We offer no service-level agreement. We may change, add or remove fields, tools and retailers, or suspend the API, at any time.

9. Fees, billing and cancellation

• Reference tier. Reference keys are free. They return the same information as the live tier on a delay, are limited to the reference tools and a daily call ceiling, and are provided for evaluation and development. There is no subscription, no fee and no service commitment: we may change the delay, the limits or the tools, and may withdraw a reference key or the tier itself, at any time and without notice. Everything else in these terms, including Sections 3, 4 and 12, applies to reference keys in full.
• Price. The live tier is $19.99 per month (plus any applicable tax), billed in advance through our payment processor, Stripe.
• Automatic renewal. Your subscription renews automatically every month at the then-current price until you cancel. You authorize us and Stripe to charge your payment method on each renewal date. We will tell you before any price change takes effect.
• Cancelling. You can cancel at any time at bujusjujus.com/account-help, which opens the billing page for your subscription, or by emailing [email protected]. Cancellation takes effect at the end of the paid period, and your key works until then. Fees already paid are non-refundable and are not pro-rated, except where the law requires.
• When your key stops working. Your key is revoked when your subscription ends, if payment finally fails after Stripe's retries, or if a payment is fully refunded or disputed.
• Usage limits. The live tier includes up to 20,000 calls per day (UTC). A wait-for-drop call that ends with no result is not counted, and each webhook delivery counts as one call.

10. Keys, webhooks and security

Your API key is shown once. We keep only a one-way hash of it and cannot recover it. You are responsible for keeping it secret and for all use of it. You are responsible for the security of any webhook endpoint you register, and for verifying the signature on every request before trusting it. We may revoke or rotate a key, or disable a webhook, at any time if we suspect compromise or misuse.

11. Suspension and termination

We may suspend or end your access at any time, with or without notice and without refund, including if:

• we believe you have breached these terms or the Terms of Service;
• a retailer, rights holder or authority complains about your use, or asks us to stop it;
• your use creates legal, security or reputational risk for us or for our other users; or
• we discontinue the API.

If we discontinue the API for everyone, we will refund the unused portion of your current paid period. You may stop at any time by cancelling. Sections 3, 5, 6, 8 and 12 to 14 survive termination.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUJUSJUJUS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THIS INCLUDES LOST PROFITS, REVENUE, DATA, GOODWILL OR PURCHASE OPPORTUNITIES; ORDERS NOT PLACED, CANCELLED OR REFUSED; AND ACCOUNTS CLOSED BY A RETAILER. IT APPLIES HOWEVER THE DAMAGES ARISE AND EVEN IF WE WERE ADVISED OF THEIR POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE API OR THESE TERMS IS LIMITED TO THE FEES YOU PAID US FOR THE API IN THE ONE (1) MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnity

The Customer will defend, indemnify and hold harmless bujusjujus LLC and its members, managers, employees and agents from and against any claim, demand, loss, liability, fine, cost or expense (including reasonable attorneys' fees) arising out of or relating to: the Customer's products or services; its end users; any purchase made or attempted with the help of API Data; any use of API Data in breach of a retailer's terms or of law; or the Customer's breach of these terms. That includes claims brought by retailers, by the Customer's end users and by governmental authorities.

14. Disputes, governing law and general terms

Terms of Service Sections 16 (Binding Arbitration & Class Action Waiver) and 17 (Governing Law & Venue) apply to any dispute about the API. These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.

There are no third-party beneficiaries of these terms. You may not assign them without our written consent. We may update them: changes take effect when posted, as shown by the "Last updated" date, and a material change applies to you from your next renewal at the latest. If you do not agree to a change, cancel before then.
